Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of johndaygolfclub.com (the “Website”), including online accounts and event or tournament ticket purchases. The Website is operated by John Day Golf Club, Inc. (“John Day Golf Club,” “the Club,” “we,” “us” or “our”).

By accessing the Website, creating an account or completing a transaction, you agree to these Terms. If you do not agree, please do not use the Website.

1. Website Purpose

The Website provides information about John Day Golf Club, including the golf course, rates, memberships, tournaments, events, clubhouse amenities, facility rentals, camping information and other Club activities.

The Website may also allow visitors to create accounts and purchase tickets for certain events and tournaments through Wix.

2. Eligibility and Legal Capacity

You must have the legal capacity to enter into a binding agreement to create an account or complete a purchase. If a purchaser is under the age of 18, a parent or legal guardian must complete the transaction on the purchaser’s behalf.

Additional eligibility requirements may apply to particular events, tournaments or membership categories. These requirements will be identified in the applicable event listing, membership form or Club policy.

3. Website Accounts

Certain Website features may require an account. When creating or using an account, you agree to:

Provide accurate, current and complete information.
Keep your login information confidential.
Promptly update information that changes.
Accept responsibility for activity conducted through your account.
Notify the Club if you believe your account has been accessed without authorization.

The Club may suspend or terminate an account if it contains false information, is used without authorization, interferes with the Website or Club operations, or violates these Terms or applicable Club rules.

Creating a Website account does not, by itself, establish or renew a golf club membership.

4. Membership Information

The Website may provide membership information and account access. Unless specifically stated otherwise, Club memberships are not purchased through the Website at launch.

Membership eligibility, dues, payment schedules, membership certificates, renewal terms and other requirements are governed by the current membership application, dues form and applicable Club rules. If information on the Website conflicts with an official membership document, the official membership document controls.

The Club may revise membership categories, qualifications, dues and benefits for future membership periods.

5. Event and Tournament Tickets

Tickets for designated events and tournaments may be offered through Wix. Event listings may include applicable dates, times, prices, eligibility requirements, registration deadlines, participation limits, and other conditions.

By purchasing or registering for an event, you agree to follow the rules and instructions associated with that event.

The Club may modify, postpone, relocate or cancel an event because of weather, course conditions, insufficient participation, safety concerns or other operational circumstances. Refunds, credits and cancellations are governed by the Club’s separate Refund Policy and any event-specific terms disclosed during registration.

A purchase is not complete until payment has been accepted and a confirmation has been issued. The Club may cancel or reject orders involving suspected fraud, unauthorized payment activity, pricing errors or violations of event requirements.

6. Prices, Payments and Refunds

Ticket prices and applicable required charges will be displayed during the purchase process. Payments made through the Website are processed using Wix and its supported third-party payment services.

The Club’s separate Refund Policy applies to Website ticket purchases and is incorporated into these Terms by reference. Please review that policy before completing a purchase.

Green fees, golf cart rentals, clubhouse purchases and certain other charges may be processed separately through NCR Voyix or another point-of-sale system. Those transactions may be subject to additional terms presented at the time of purchase.

7. Club Rules and Separate Agreements

These Terms govern use of the Website, Website accounts and applicable online ticket transactions. They do not replace:

Golf course or clubhouse rules.
Tournament or event rules.
Membership applications and dues forms.
Facility rental agreements.
Participant releases or waivers.
Harvest Hosts requirements.
Other agreements required for a particular Club activity.

Visitors, members and event participants remain responsible for complying with all applicable Club rules and separate agreements.

8. Acceptable Use

You may use the Website only for lawful, personal and noncommercial purposes. You may not:

Copy, reproduce, republish, distribute or commercially exploit Website content without written permission.
Interfere with the Website’s operation, security or availability.
Attempt to gain unauthorized access to an account, system or data.
Introduce malware, harmful code or disruptive technology.
Use automated systems to scrape, harvest or extract Website content or data.
Misrepresent your identity or affiliation with another person or organization.
Use the Website to engage in fraud, harassment, spam or unlawful conduct.
Circumvent registration limits, ticket restrictions or other Website controls.

9. Intellectual Property

Unless otherwise stated, the Website and its text, photographs, videos, graphics, logos, design elements and other content are owned by or licensed to John Day Golf Club and are protected by applicable intellectual-property laws.

You may view Website content for personal, noncommercial use. You may also download and print documents that the Club expressly makes available for that purpose, including applications, scorecards, agendas, minutes and rental agreements.

Permission to download or print a designated document does not transfer ownership or permit modification, resale, republication or commercial use. Any other copying or use requires prior written permission from the Club or the applicable rights holder.

10. Privacy

The Club’s separate Privacy Policy explains how personal information submitted through the Website is collected, used and protected. The Privacy Policy is incorporated into these Terms by reference.

By using an account or submitting information through the Website, you acknowledge that you have reviewed the Privacy Policy.

11. Electronic Communications

By creating an account, registering for an event or completing a purchase, you consent to receive transaction-related electronic communications, including confirmations, receipts, event updates, schedule changes and account notices.

Marketing communications will be sent in accordance with applicable law and the preferences associated with your account. You may unsubscribe from promotional emails using the instructions included in those messages. Unsubscribing from marketing does not prevent necessary transactional or account communications.

12. Third-Party Services and Links

The Website may use or link to services operated by third parties, including Wix, payment processors, NCR Voyix, Harvest Hosts, mapping providers, social-media platforms and video-hosting services.

The Club does not control these third-party services and is not responsible for their content, availability, security, privacy practices or performance. Your use of a third-party service may be governed by that provider’s own terms and policies.

A link or integration does not constitute an endorsement or guarantee by the Club.

13. Accuracy and Availability

The Club makes reasonable efforts to keep Website information accurate and current. However, rates, schedules, course conditions, event details, membership information, hours and other content may change.

The Club does not guarantee that the Website will always be uninterrupted, secure, error-free or current. We may correct errors, update content, restrict access or discontinue Website features without prior notice.

Visitors should contact the Club when information is time-sensitive or requires confirmation.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis without express or implied warranties.

The Club disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement and any warranty arising from course of dealing or usage of trade.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be waived.

15. Limitation of Liability

To the fullest extent permitted by law, John Day Golf Club and its directors, officers, volunteers, employees and representatives will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to:

Use of or inability to use the Website.
Website errors, interruptions or security incidents.
Reliance on Website content.
Third-party websites, services or content.
Unauthorized access to an account.
Changes to event information or Website availability.

If the Club is found liable for a claim related to a Website transaction, its total liability will not exceed the amount you paid to the Club for the specific transaction giving rise to the claim. If no payment was made, total liability will not exceed $100.

These limitations do not apply where prohibited by law.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless John Day Golf Club and its directors, officers, volunteers, employees and representatives from claims, losses, liabilities and reasonable expenses arising from your unlawful misuse of the Website, violation of these Terms or infringement of another party’s rights.

17. Suspension and Termination

The Club may restrict, suspend or terminate your access to the Website or an account if you violate these Terms, misuse the Website, engage in suspected fraud or create a risk to the Club, other users or Website systems.

Provisions that should reasonably continue after termination—including intellectual-property, disclaimer, liability, indemnification and dispute provisions—will remain in effect.

18. Changes to These Terms

The Club may update these Terms to reflect changes in the Website, Club services, business practices or legal requirements.

Updated Terms will be posted on the Website with a revised effective date. Your continued use of the Website after an update becomes effective constitutes acceptance of the revised Terms.

Material changes affecting an existing purchase will not be applied retroactively unless permitted by law or accepted by the purchaser.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles.

Before filing a legal claim concerning the Website or an online transaction, you agree to make a reasonable effort to contact the Club through the Website’s Contact page and allow the Club an opportunity to respond.

Any legal action arising from these Terms will be brought in an appropriate state court located in Grant County, Oregon, or an applicable federal court in Oregon, unless applicable law requires otherwise.

20. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. An unenforceable provision will be interpreted as closely as legally permitted to its original purpose.

The Club’s failure to enforce a provision does not waive its right to enforce that provision later.

21. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, applicable event terms and any separate agreement governing a Club activity, constitute the agreement between you and the Club regarding the Website and applicable online transactions.

If an event-specific term conflicts with these Terms, the event-specific term controls for that event.
